Risk Assessment

Act 95 of 2010 mandates the Commission on Sentencing to develop a risk assessment instrument to assist the court at sentencing.  Specifically, the Act requires that the Commission:

  • Consider the risk of re-offense and threat to public safety;
  • Help determine if an offender is a candidate for alternative sentencing programs;
  • Develop an empirically based worksheet using factors predicting recidivism; and
  • Adopt a sentence risk assessment instrument to be used at sentencing.

To address this new mandate, the Commission undertook extensive research in the development of the Sentence Risk Assessment Instrument, documenting its work in a series of interim reports.
